Birds around Woodbridge Island and Table Bay Nature Reserve, Cape Town
I had an appointment deferred this morning and with the good light decided a mid-morning of bird photography outside could deliver reasonable results. It will be winter in Cape Town soon and will provide for a good opportunity to have a close look at the water quality and current bird species around the Diep River and the Milnerton Lagoon.

My first meaningful sight, apart from the king gulls, were a few relaxed lessor flamingos wading quite close to the wooden bridge. It was very encouraging to see the white-breasted and reed cormorants fishing in the Diep River, zig-zagging ferociously across the river chasing after the fish. The cormorants were closely followed by an entourage of opportunistic little egrets. The familiar sight of swift terns constantly diving for fish looked like the quality of the water is hopefully improving with the interventions by the City of Cape Town for restoring the quality of the water flowing down the Diep River.

Like many others, I hope these are sustainable solutions after years of neglect and decay of this particular natural urban ecosystem.

Blue Hour Long Exposure Photography Training Milnerton, Cape Town

This offer is available for individual photographers or small group bookings (up to four delegates). With scalable training rates from two to four delegates.

Flexible Training Dates
Sessions to be scheduled with individual delegates / groups in terms of everybody's availability and could be during the week / weekends.

Training Objective: Blue Hour Photography
To assist the developing Canon EOS photographer with mastering landscape and long exposure photography with the main focus on blue hour long exposures working with changing natural light (before sunrise and then sunset and beyond).

Required Photography Equipment
Any Canon DSLR camera with any lens in the 10mm - 70mm focal length range. (i.e. the Canon EF-S 18-55mm lens is more than suitable). A sturdy tripod is a mandatory requirement for long exposure photography.

Blue Hour Landscape Photography Essentials

"Blue hour is a captivating time for landscape photography, occurring during the transition between day and night when the sun is below the horizon but still illuminates the sky with a deep blue hue. This period provides a unique and soft light that can enhance the mood and atmosphere of your photographs. Here are some tips for capturing stunning blue hour landscape photos:

1. Timing is Key
  • Blue hour generally occurs during the 20-30 minutes before sunrise and after sunset. Check the local time for sunrise and sunset in your location to plan accordingly.

2. Scout Locations in Advance
  • Identify interesting landscapes and compositions during daylight hours. This preparation will help you make the most of the limited blue hour time.

3. Use a Tripod
  • The low light conditions during the blue hour require longer exposure times, so using a tripod is essential to avoid camera shake and ensure sharp images.

4. Adjust White Balance
  • Set your camera's white balance to "Tungsten" or manually adjust it to a cooler temperature. This helps enhance the natural blue tones of the scene.

5. Shoot in RAW
  •  Capture images in RAW format to retain more information and flexibility during post-processing.

6. Experiment with Exposure Settings
  • Since light levels are changing rapidly during the blue hour, experiment with different shutter speeds and apertures to find the optimal settings for your scene.

7. Include Foreground Elements
  • Incorporate interesting foreground elements to add depth and context to your photos. This could be a silhouette of a tree, rocks, or any other object that complements the landscape.

8. Use Graduated Neutral Density Filters
  • Graduated ND filters can help balance the exposure between the bright sky and darker foreground, especially when there's a significant contrast in light.

9. Long Exposure Techniques
  • Consider using longer exposure times to capture movement in clouds, water, or other elements. This can create a dreamy and ethereal effect.

10. Bracketing for HDR
  • Bracket your shots to capture a range of exposures, especially if there's a high contrast between the bright sky and darker landscape. This allows you to create HDR (High Dynamic Range) images in post-processing.

11. Silhouettes and Reflections
  • Utilize silhouettes of mountains, trees, or other elements against the colorful sky. Additionally, bodies of water can provide beautiful reflections of the blue hour sky.

12. Post-Processing
  • Fine-tune your images in post-processing to enhance colors, contrast, and sharpness. Pay attention to the overall mood you want to convey in the final image.

Remember, blue hour photography is not just about capturing a scene but also about conveying the mood and emotion of that specific time. Experimenting with different techniques and settings will help you find your unique style during the blue hour." (Source: ChatGPT 2023)

Copyright Infringement : Using Images Without Permission (in South Africa)

It is every photographer's own responsibility to be vigilant in terms of images being used without permission and to take the necessary steps to manage / report copyright infringement(s) to the appropriate on and / or offline establishments / advertisers / legal authorities.

International Image Copyright Law >>

Copyright Law Applicable to Photographic Images South Africa

In South Africa, copyright law regarding photographic images is quite specific. Here are some key points:

Copyright Ownership: In South Africa, copyright automatically vests in the photographer once the photo has been created in material form. However, if the photograph is commissioned, the person who commissions the photograph obtains ownership 1.

Duration of Copyright: A copyright is valid for 50 years from when the image was first made public or first published, whichever is longest 2.

Rights of Freelance Photographers: There is a contentious issue where commissioned photographs are owned by the commissioner (client), meaning freelance photographers may have no rights to their work. This can be circumvented by mutual agreement, which then comes under contract law and overrides the default terms of the Copyright Law 3.

Use of Photographs: Photographs taken for personal use, news reports, art, information, education, and politics are generally within the rights of the photographer. However, commercial use requires signed model releases, even if the subject is a public figure or celebrity photographed in a public place 2.

These points highlight the importance of understanding and negotiating copyright terms, especially for photographers in South Africa. For more detailed information, it’s advisable to consult legal experts or refer to resources provided by photography associations and legal advisories in South Africa. International Image Copyright Law

International Image Copyright Law: Awareness and Resources
International Image Copyright Law
"International image copyright law is a complex area that encompasses various treaties, agreements, and national laws aimed at protecting the rights of creators and owners of visual content. Here are some key points regarding international image copyright law:

  • Berne Convention for the Protection of Literary and Artistic Works: The Berne Convention, established in 1886 and revised several times since then, is one of the cornerstone treaties in international copyright law. It sets minimum standards for copyright protection among its member countries and establishes the principle of automatic copyright protection upon the creation of a work.

  • Universal Copyright Convention (UCC): The UCC is another international copyright treaty that provides a framework for copyright protection, especially for countries that are not members of the Berne Convention. It offers similar protections as the Berne Convention but with some differences in its requirements.

  • Copyright Duration: The duration of copyright protection varies between countries, but the general trend is towards longer protection periods. In most countries, copyright protection lasts for the life of the author plus a certain number of years after their death. However, the exact duration can vary, and some countries also have different rules for works created by corporations or anonymous authors.

  • Fair Use and Fair Dealing: Many countries have provisions in their copyright laws that allow for the limited use of copyrighted works without permission for purposes such as criticism, commentary, news reporting, teaching, scholarship, or research. These provisions are often referred to as "fair use" (in the United States) or "fair dealing" (in other countries).

  • International Treaties and Agreements: In addition to the Berne Convention and the UCC, there are other international agreements that address copyright issues, such as the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), which is administered by the World Trade Organization (WTO).

  • Enforcement and Remedies: Enforcement of copyright laws varies between countries and can involve civil and criminal remedies. Civil remedies often include injunctions, damages, and orders for the infringing party to cease their infringing activities. Criminal remedies may involve fines and imprisonment for serious copyright infringement.

  • Digital Environment: The rise of digital technology has posed new challenges to copyright enforcement, particularly with regards to online distribution and sharing of images. International efforts, such as the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty, aim to address these challenges and provide a framework for protecting copyrighted works in the digital environment.

It's important to note that while there are international standards and agreements regarding copyright protection, each country has its own copyright laws and regulations, so the specifics of image copyright law can vary from one jurisdiction to another." (Source: ChatGPT 2024)
